Key provisions of the GDPR

Any organization, regardless of its location, that processes personal data of individuals located in the EU and EEA falls under the purview of the GDPR. Personal data, which includes a person’s name, email address, or IP address, among other identifiers, can be used to identify an individual.

Having a data center in the EU provides several advantages, including:

1. Consent: Before collecting, processing, or sharing personal data of individuals, organizations must obtain their explicit and informed consent.

2. Privacy by design: To ensure data protection, organizations must implement appropriate technical and organizational measures and design their systems and processes with data privacy in mind.

3. Data subject rights: Under the GDPR, individuals have several rights, including the right to access, correct, and delete their personal data. They also have the right to object to processing and to data portability.

4. Data breach notification: If an organization becomes aware of a data breach that poses a risk to individuals’ rights and freedoms, they must notify the relevant supervisory authority within 72 hours.

5. Data protection officer: Organizations, including ours, are required to appoint a data protection officer (DPO) to ensure compliance with the GDPR and act as a point of contact for individuals and supervisory authorities.

5. Non-Compliance fines: Non-compliance with the GDPR can result in significant fines, with penalties of up to 4% of an organization’s global annual revenue or €20 million, whichever is greater.
